Berbice farmer granted injunction against MMA

A Cotton Tree, West Berbice rice farmer has obtained an interim injunction preventing the Mahaica-Mahaicony-Abary/Agricultural-Development-Authority (MMA-ADA) from repossessing, reallocating or cancelling his title licence: A-105, on the grounds that it is illegal. 

Manzoor Ali-Khan moved to the court in response to an urgent notice in the May 1 edition of the Kaieteur News.
Ali-Khan’s motion sought an order that the MMA-ADA’s move is illegal, unlawful, ultra-vires, null and void and in breach of privilege of natural justice.

He claims that authority has failed in its contractual agreement to provide drainage and irrigation and access maintenance to rice fields.

The injunction also restrains the defendant, its servant/agent or otherwise from repossessing, reallocating and or cancelling the licence title A-105 containing 1,667 acres in Area Number 5/Cotton Tree, Zeezight and second depth land in Sections A, B, C, D, E and F. Ali-Khan is also claiming damages in excess of $50,000 for breach of contract.

The matter was called on Thursday last and has been adjourned to Friday.
