– JSC mulls demotion
The Judicial Service Commission (JSC) is yet to reach a decision on the fate of Magistrate Gordon Gilhuys, who has been off the bench for almost two months since being involved in a shooting incident with a member of the police force.
A source told Stabroek News that the JSC is leaning towards demoting Gilhuys, reportedly to the deputy registrar’s office at the Supreme Court Registry. The move is said to have been proposed because of concerns about how Gilhuys’ return to the magistracy would affect the image of judiciary. The source added that another major consideration is the backlog of cases that Gilhuys has left. There are disagreements about whether Gilhuys should be allowed to return to the bench to finish outstanding cases or whether they should be transferred to another magistrate.
Director of Public Prosecution Shalimar Ali-Hack has recommended that no charges be laid against Gilhuys, owing to deficient police statements on the incident.
On June 26, Corporal Mark George and his colleagues were on patrol on Woolford Avenue when they noticed a vehicle with tinted windows parked on the roadway. The policemen made checks and an argument ensued between them and the driver, who was later identified as Gilhuys. It is claimed that the magistrate opened fire, and an exchange ensued during which George was hit. Gilhuys has maintained that he was fired upon first and that he returned fire.
Pending the investigation into the matter, Gilhuys proceeded on annual leave.
Stabroek News has been told that the DPP’s review of the case is likely to carry some weight in the JSC deliberations.

He should be tried. I remember a person being charged and sent to jail for a spent shell . Is is time that justice is served to all regardeless of class and social standing .
Guyana is a cow boy country, you can get away with almost anything, I remember a few months when the PPP cabinet minister discharged his fire arm and beat up a young kid we are not hearing anything about that anymore, what we need in Guyana is the consitution to amend, no government ministers should be member of parliment. Because you know they are going to be a rubber stamp to the Government.
Gordon Gilhuyse should not have been a Magistrate to begin with.
Faceboy I will like to give you my full support. There are matters in which this Magistrate is involved. We have sought Legal Advice. We are gathering the evidence. The witnesses are still around. Its only a matter of time. Some of his old friends are prepared to spill the beans.
I have a lawyer who once told a group of us that gov’t want to promote him – to magistrate/judge- (cannot recall) but he decline because he would no longer be allowed to associate with us – his ordinary friends ( of course not in Gy).
At first this incident surprised me – may be because of what our lawyer friend had told us – but then the ‘reality of Guyana” hit me.
If we do not have any regard for the law /s of a country that we live in then we should not think of becoming law enforcers – police, lawyer, magistrate, judge – if we cannot practice it.
Last week a man get charge for stealing 2 mangoes from chronicle news and got wes order to keep the peace for a couple of months, who is this magistrate that his case is being prolong so long and then there are recomendations that he be demoted. I went to school 20 of my 24 years of my life to know what justice is and this is not justice. Lets wake up and see the light and speak out for all these injustice that is going on.
Don’t forget guys. In GT as long as you are well connected you get a slap on the wrist. Remember the Minister’s fiasco with the gun? How much different is that from the magistrate’s. However Errol Alfonso will feel the full brunt of the law. Comments are welcome, good or bad.
Mr: Alphanso, is a former member of the PNC and not the ruling PPP so of course he’s going to face the music. We need equal rights and justice for all.
Faceboy, Mr Alphanso has been dealt with accordingly, even though he is P.N.C.As you say we need Justice and Equal Rights. We will have to lift, our voices continuously. Thanks to Stabroek News, for helping us to make our voices heard. In bygone days,we had to keep quiet,or else.Lets keep up the fight,Justice for All.Thanks again S.N.
gordon gilhuys should not have been appointed to the bench.
faceboy, queen bee and yvette, I am with you all, the man should not have been appointed to the bench.
we need to keep the pressure on.
And why is George Marks afraid to press for charges? Politics should not play a part in justice being served.
Thanks SN for providing this forum, so we can pressure the judicial system.
