 – JSC mulls demotion
The Judicial Service Commission (JSC) is yet to reach a decision on the fate of Magistrate Gordon Gilhuys, who has been off the bench for almost two months since being involved in a shooting incident with a member of the police force.

A source told Stabroek News that the JSC is leaning towards demoting Gilhuys, reportedly to the deputy registrar’s office at the Supreme Court Registry. The move is said to have been proposed because of concerns about how Gilhuys’ return to the magistracy would affect the image of judiciary.  The source added that another major consideration is the backlog of cases that Gilhuys has left. There are disagreements about whether Gilhuys should be allowed to return to the bench to finish outstanding cases or whether they should be transferred to another magistrate.

Director of Public Prosecution Shalimar Ali-Hack has recommended that no charges be laid against Gilhuys, owing to deficient police statements on the incident. 

On June 26, Corporal Mark George and his colleagues were on patrol on Woolford Avenue when they noticed a vehicle with tinted windows parked on the roadway. The policemen made checks and an argument ensued between them and the driver, who was later identified as Gilhuys. It is claimed that the magistrate opened fire, and an exchange ensued during which George was hit. Gilhuys has maintained that he was fired upon first and that he returned fire.

Pending the investigation into the matter, Gilhuys proceeded on annual leave.
Stabroek News has been told that the DPP’s review of the case is likely to carry some weight in the JSC deliberations.

    If nothing wasn’t done to him since the incident why do we think anything is gonna be done now, demoting him is not justice. And the beat goes on.

  2. Two weeks ago Robert Simels, Roger Khan attorney was charged with
    conspiracy to tamper with witnesses and among other things he is
    accused of paying US$1,000 and discussing eliminating and neutralizing
    witnesses, he is on $3.5 million bail.

    Mr Gordon Gilhuys was involved in a shooting with a police officer with a unlicensed
    firearm and Madam Ali-Hack of the DPP has recommended that no charge
    be laid against Mr Gilhuys.

    Now i’m reading that the Judicial Service Commission is yet to reach
    a decision on the magistrate fate.

    What is there to decide about, this man “MUST GO”.

      My point exactly, with these kinds of shannanigans how will there ever be “genuine peace” in Guyana???? People with unlicenced firearms in their possesson are usually incarcerated. Now, here we have a magistrate who should be enforcing the law, has an unlicenced firearm, shoots during a confrontation with a law-enforcement officer & the DPP recommends that NO CHARGES BE LAID against this “person”. So little “Balgobin” gets a gun & starts shooting police because if big guys can do it & get off why not me???? A land of six peoples & we are ALL EQUAL …………… or are there some more equal that others!?!?!

      That’s right. The flimsy excuse is that the police statements are inadequate. But he turned in his unliscensed weapon and ballistics can link him to the shooting just like they linked fineman to every other shooting in the territory. Who needs police statements? At least they can get him on the weapons charge!

    The related information at hand and the shadow of impropriety that now covers this sordid affair should be enough to render the decision of the JSC quite simple. In any civilised modern society Gilhuys would have already been placed before the courts of the land and dealt with in accordance with the law.

    What a joke.Was it a person of lower status a charge would,ve been leveled aainst him for being with an ulnlicenced firearm.
    The perception that one sees here is protection of ones fellow brethren.No way can the small man see his way forward having a level playing field when the onside is stacked against you,and the ball ius being bowled wide of the leg stump.

    RA and the other bloggers, the JSC is different from the DPP and teh courts. The latter two bodies should have instituded charges. In the absence of charges, the JSC’s hands are tied to take substansive action. The JSC is doing its best by contemplating a demotion. Say something that make sense, dudes. The move by the JSC is not about justice, but about behavioural issue.

    According to the DPP no charges will be laid against the magistrate. If this body is responsible for making decissions about prosecutions and have done so, then this matter is closed. We cannot have a law within the law. If no charges then the magistrate is cleared to resume his duties. The backlog of cases continue during indecissions. Someone needs to make a decission. The longer we procrastinate, the more cases are added to the backlog. Guyanese, please be efficient. Stop the porcrastinating.

      Mr: Mack, I sorry that you felt that way. Justice must be serve for the victim in this case. One month ago, a man discharged a loaded firearm at his neighbour’s house and two weeks ago the DPP recomended that he be charge and his firearm’s licence revoke. The difference is the magistrate shot at and wounded a human being; to with:a police officer in uniform executing his duties and the other man, well, he shot at a building and did’nt hurt anyone. Now Mack tell me where this does’nt make sense to you. Mr: Gilhuys must be charge because he’s not above the law. This man did other evil and criminal things you know nothing of.

    Who cares about the backlog of cases he has on his hands?

    Where in the civilized world, would a magistrate even dream of opening fire on policemen with an unlicensed firearm?

    What is the message being sent here? Is it ok to open up with unlicenced weapons so long as you have enough clout?

    And it matters not who shot first, he should have been prudent and surrender to the officers and maybe press charges later on.

      You guys are talking about an unlicensed firearm. The police said the firearm was not registered for 2008. We are still in 2008. What is procedure for registration, do you know? What is the dead line to register your firearm for the year? Remember the weapon was given to him by the police to protect himself.

    Dear Editor, I’ve been writing letters everyday on behalf of the victim in this sad matter and intend to continue until Mr: Gilhuys is charged over the shooting and being in possession of an unlicensed firearm. I’m an ex-cop and have spoken to many ex-cops living within the New York area who also agreed that the ex- magistrate should be charged. Just last week the ex- Mayor of New Amsterdam Mr: Errol Alphanso was charged with attempted murder, with little or no evidence to support such a charge. He not above the law and as such should face it like any other. More importantly we the bloggers on this site must keep the pressure on the government {DPP} so as to ensure that JUSTICE is serve in this case.
