Eldeus Burke of Linden appeared yesterday  before Magistrate Ann McLennan on the indictable charge of felonious wounding following a scuffle that was triggered when the virtual complainant made a remark to a woman about her ‘bow foot’ in the Mackenzie Market.

Testifying in the matter, complainant Cleon Lespair of 315 Wisroc Housing Scheme, Wismar, Linden, told the court that on November 19, 2008 he and the defendant were involved in a scuffle in the Mackenzie Market Square when he was chopped in the face with a ‘chopper’ by the defendant.

He said that he was also stabbed six times about his body by a man believed to be a friend of the defendant on the same day.

The incident was fuelled the previous day when Lespair said he commented to a young woman about her ‘bow foot’ while in the Mackenzie Market.

Given an opportunity to cross-examine the witness, Burke’s attorney-at-Law attached to the Legal Aid Unit, Joan Ward-Mars asked that the matter be recalled at a later date to allow her time to read her client’s statement which she had only received a few minutes before the matter was called. The case is to be tabled again on July 8 when the prosecution is also expected to present other witnesses.

At his first court appearance on December 3, 2008 Burke was placed on $200,000 bail and this was subsequently reduced to $150,000 when the matter was called again on January 21 this year.
