No evidence was led in court during the trial of security guard David Chesney that Oneil Adams had been handcuffed when he was shot at the KFC Stabroek Outlet on February 25, 2005.
A legal entity directly involved in the case explained yesterday that evidence led by the prosecution purported that Adams was handcuffed at the time he was shot, as this had been reported by the police.
“Evidence was led to show that Adams had been handcuffed on the day in question but the prosecution failed to provide the court with evidence showing exactly when Adams was handcuffed,” the lawyer said. “It was never established by the prosecution to the court whether Adams was handcuffed before or after he was shot.”
It was based on this failing by the prosecution that Justice James Bovell Drakes on Tuesday ordered defence attorney Vidyanand Persaud to make a no-case submission.
Following the no-case submission the judge then directed the jury to return a verdict of not guilty to manslaughter.
