Canvas City man jailed for two break-ins and indecent assault

A man from Canvas City, Wismar, was on  Tuesday sentenced to prison on two counts of break and enter and larceny and indecent assault when he appeared before Magistrate Ann McLennan at the Christianburg Magistrate’s Court.

The court was told that twenty-eight-year-old Horsheal Higgins of 75 Canvas City, Wismar, Linden, between November 18-19, 2011 broke and entered the dwelling house of Kevin Bess at  One Mile, Wismar, Linden and stole one cellular phone valued $12,000.

The prosecution said also that on November 22, 2011 Higgins broke and entered a dwelling place at Block 22 Wismar, Linden and stole one BlackBerry cellular phone valued $13,000 and  three louvre panes valued $900.  The court also heard that on the same day he indecently assaulted the virtual complainant. On his initial appearance the defendant pleaded not guilty to the charges  and was remanded to prison.

In handing down the sentence, Magistrate McLennan said that the court’s decision was reached upon consideration of the evidence presented by the prosecution and the witnesses and based also on the fact that the accused was positively identified.

Higgins, a gold miner, was sentenced to three years in prison for break and enter and larceny and 18 months for indecent assault.
