Justice BS Roy handed down a million dollar judgment at a recent sitting of the Commercial Court.

Court documents show that Justice Roy granted judgment for plaintiff Shameena Rahaman against defendant Abdel Fiaaz Manan, of 49 Tuschen, East Bank Essequibo, in the sum of $1M.

Additionally, the judge granted interest at 6% per annum from December 13, 2006 until January 31 and thereafter at 4% until payment.

According to the State-ment of Claim, Manan, in a promissory note dated June 3, 2004 promised to pay the plaintiff the said sum within one year after the agreement. The claim said that to date the defendant has failed or refused to pay all or any of the sums despite repeated demands.

Attorney-at Law Anil Nandlall appeared for the plaintiff. There was no appearance of or for the defendant.

In the case of plaintiff Idris Deen against defendant A. Mazaharally and Sons Limited, of Wights Lane, Kingston, Justice Roy granted judgment in the sum of $765,000. Additionally interest was granted at 6% per annum from December 18, 2006 until February 7 and thereafter at 4% until payment. A four month stay of execution was granted by consent

According to the Statement of Claim, the plaintiff, of E 81 Lamaha Street, Alberttown, pursuant to a 2001 High Court Action sued the defendant for the sum of $2,248,000 in addition to interest and cost, and subsequently entered into an out-of-court written settlement on October 19, 2002. As a result of the settlement on the said action, the matter was withdrawn. Further, the claim said that pursuant to the settlement, the defendant agreed to pay $1.6M to the plaintiff in full and final settlement of the said action, agreeing to liquidate the said sum in installment payments by October 31, 2003.

The court documents said that the sum of $700,000 was paid on the outstanding sum leaving a balance of $900,000.
