This complaint of noise nuisance has been fully investigated

With reference to your letter of 2007-09-20 which was addressed to Commander ‘G’ Division, enclosing a letter from Mr Mohamed Khan captioned “Noise nuisance has been fully investigated”, I wish to advise that the police mounted an investigation into the complaint by Mohamed Khan.

According to Rakesh Samaroo, Manager of Boodhoo’s General Store, Awad Boodhoo had rented a portion of Khan’s yard to build a bond which stored zinc sheets, steel rods and other articles and a fee of $100,000 annually was paid to Khan. This was done on January 15, 2002 and the arrangement existed for a period of three years. Subsequently, Khan asked for an increase in rent and Boodhoo refused.

During subsistence of the contract, there was never any complaint from Khan of noise nuisance against Boodhoo’s General Store. On termination of the contract, Boodhoo built a bond of similar dimension in Boodhoo’s yard. Thereafter, Khan began to make complaints against Boodhoo’s store.

Firstly, it was dust emanating from off-loading cement at Boodhoo’s premises. As a result, an enclosure was built north of Boodhoo’s General Store to store cement. Since this happened there was no more complaint of dust pollution.

This was followed on September 18, 2007 by a report of noise nuisance to the Anna Regina Police Station arising from noise emanating from the movement of steel rods in the bond. The police visited the scene and advised the business to control the movement of steel rods. Despite these actions by the police, another letter appeared in the Stabroek News dated September 21, 2007 captioned “Noise Nuisance from Hardware Store.”

The police carried out investigations and took statements from the complainant and Rakesh Samaroo. It is notable that there is a lumber yard in the complainant’s yard, a STIHL store under the complainant’s home which sells chain-saws which are required to be tested before being given to customers and a snackette in the complainant’s yard in which music is played from a tape recorder. It is also notable that the noise level emanating from these arrangements does not affect the complainant. He is only affected by the noise coming from the bond of Boodhoo’s General Store.

The Commander has since been advised to seek legal advice in the matter. I shall advise you further.
