Guyanese jailed over having sex with BVI minor sues Chief Immigration Officer

Dellon Williams, the Guyanese who on Tuesday had his five-year sentence for having sex with a minor reduced to three years, has now sued the Chief Immigration Officer of the British Virgin Island (BVI) for allegedly using his powers to falsely arrest him in December, 2008, the BVI Platinum News has reported.

According to the report, Williams, who has been lawfully living in the BVI since October 2005, wants the court to declare that he was falsely imprisoned by the Chief Immigration Officer (CIO), his agents or servants. He is claiming general damages for false imprisonment by Jennings and his agents or servants and punitive damage for false imprisonment which was actuated by malice, spite and by an abuse of power by the CIO.

Williams, who fathered a child with the girl who was under the age of 16, has claimed that he was at his Belle Vue home on December 5, 2008 around 4 am when he was arrested by immigration officers on the grounds that he had committed an immigration offense.

He was then taken to a police station and placed in the lockups around 5 am and was allegedly told by officers that they will return for him at 9 am on the said morning. They did not return nor was he charged with any immigration offence.

The convict said he was kept in the lockups from 5 am to 3 pm on that very date and he was not read his rights or given an opportunity to seek a lawyer.

At 3 pm the man said he was then informed by a police officer that he is accused of committing an offence of having unlawful sexual intercourse with a girl under the age of 16 years old. The girl is said to be a relative of the Chief Immigration Officer.

Williams is being represented by Vernon E Malone & Co. law firm.

Late last year, Williams had pleaded guilty to the charge of having unlawful sexual intercourse with a girl under the age of 16 years after a paternity test proved that he was the father of the teenager´s child. A few days later he changed his plea to not guilty.

According to the prosecution, Williams invited the teen who had been friends with him to his home some time before or after the April 11, 2008. The virtual complainant went to the convict’s home and she was then invited into his bedroom. It is there he started kissing her and then took both of their clothing off. The VC had testified that she then started to put up resistance, but was unsuccessful as Williams managed to have sex with her.

The child did not say anything to her parents. However, some time in October her parents noticed that she was not menstruating and a visit to the doctor confirmed that she was eight months pregnant. She then related what had transpired with Williams.

Williams has two children in Guyana who he takes care of, as well as his mother.
