Court hears Jawalla man shot while trying to save sister from beating

The man who allegedly shot 38-year-old Aaron Hunter to his left knee during an argument at Jawalla Village was put on  $200,000 bail on Friday by acting Chief Magistrate Priya Sewnarine-Beharry.

According to the particulars of the charge, on February 7 the accused Osai Cappill discharged a loaded firearm at Hunter with  intent to maim, disfigure or cause the man grievous bodily harm.

The accused also had a charge of felonious wounding levelled against him. He was not required to plead to the charges  which are indictable.

In presenting the police facts, Prosecutor Lionel Harvey said that the accused has a relationship with the VC’s sister.

He added that on the day, the VC overheard the accused beating his sister and he intervened. According to Harvey, the accused became annoyed and fired shots at Hunter who sustained two gunshot wounds and is still hospitalized.

The court was told that the injured Hunter was rushed to the Kamarang Hospital and was later transferred to the Georgetown Public Hospital.

The prosecutor noted that the VC is hospitalized due to the injuries he sustained.

Attorney-at-law Neil Boston argued that his client should be placed on bail arguing that there is no report from the police stating that  his client would interfere with the course of justice.
The attorney also told the magistrate that there is a  conspiracy by persons to get the “multifaceted” Cappill out of the community in order to unjustly enrich themselves. “The VC always asked  his sister for financial assistance… but his sister has to ask the accused first,” the attorney noted.

After listening to the submission the acting chief magistrate granted Cappill $150,000 bail on each charge. The attorney, however, made a successful application for the bail to be reduced to $100,000 on each charge.

The matter was transferred to the Kamarang Magistrates’ Court for March 19.
