Burglary case dismissed after VC decides not to proceed

A case of burglary was yesterday dismissed after the virtual complainant (VC) informed the court that he did not wish to give evidence against the accused.

Michael Smith was before the court charged with breaking into Marlon Thomas’s home and stealing an iPhone valued at $140,000, a BlackBerry phone valued at $45,000, three packs of cigarettes valued at $1,200 and $7,000, all totalling $193,200.

However, Smith’s lawyer informed the court that the VC had indicated to her that he did not wish to give evidence against Smith.

Samuels was asked by the magistrate to enter the witness box to swear to this, which he did.
The prosecution then informed the court that they would be unable to proceed with the matter, because no evidence was being offered.

Magistrate Leron Daly then dismissed the matter.
