Magistrate criticizes absence of witnesses in Carolan Lynch inquiry

Chief Magistrate Priya Sewnarine-Beharry yesterday decried the prosecution’s failure to present witnesses when the Preliminary Inquiry (PI) into the murder charge against Carolan Lynch, accused of killing her husband, Swiss House Cambio boss Farouk Razack, continued.

Two witnesses, Lynch’s brother-in-law, Fazeel Razack and Sergeant Lillian Scotland, testified yesterday before the Chief Magistrate, who is presiding over the PI at the Georgetown Magistrates’ Court 1. The witnesses were also cross-examined by the former beauty queen’s attorney, Peter Hugh.

According to Prosecutor Bharat Mangru, approximately 12 witnesses are still to testify, including the daughter of Lynch and Razack. The remaining witnesses for yesterday’s hearing were not present even though arrest warrants were issued for them.

Commenting on the situation, Magistrate Sewnarine-Beharry cautioned Mangru that Lynch should not be kept in custody for an extended period of time. She declared that the court called for witnesses since January and the failure of the prosecution to present witnesses at this point is unbecoming.

Lynch was first charged in May of 2007 after Razack was found dead on the floor of their Eping Avenue, Bel Air home. Following a PI, then Magistrate Gordon Gilhuys in late December 2007 had ruled that no prima facie case was made out against her and she was subsequently discharged. However, police subsequently brought the charge against her once more.

The PI will continue next Wednesday.
