Jamaica: Cousins freed of murder committed 10 years ago

(Jamaica Gleaner) Ten years after two men were charged with murder, they gained their freedom yesterday in the St Thomas Circuit Court.

They are cousins 39-year-old Lenardo Tucker and Dujon Tucker, labourers of Pound Lane, Yallahs, St Thomas who were charged with the murder of 17-year-old Horace Leray, also called “Youth” of New Market, near Yallahs.

Leray was fatally shot on Pound Lane on January 13, 2009.

The men were freed following no case submissions made by defence lawyers Hensley Williams and Horace Gray.

The lawyers argued at the close of the prosecution’s case that the identification evidence was very weak.

A prosecution witness had testified that on the day of the incident he heard about nine gunshots and seconds later, he saw two men running.

The witness said he made a report to the police and gave the alias of the men he saw running.

The witness admitted under cross-examination that he did not attend an identification parade in relation to the case.

The lawyers argued that the Crown could not prove that the accused men committed the murder.

They argued that no identification parade was held for the witness to identify the men he saw running.

Justice Yvonne Brown upheld the no case submissions and directed the jury to return verdicts of not guilty.
