Bill sets out details on plea bargaining

Attorney General and Minister of Legal Affairs, Anil Nandlall on December 11 tabled the Criminal Procedure (Plea Discussion, Plea Agreement and Assistance Agreement) Bill of 2023 in the National Assembly.

The Bill, which is divided into five parts and contains thirty-eight clauses and one schedule, provides for the application of the Act to both summary and indictable offences and expressly clarifies that the Act does not affect the right of an accused person to plead guilty without entering into a plea bargaining nor the right of an accused person to seek a sentencing indication from the Court.

It also provides a definition for an assistance agreement and plea agreement and their scope.
