(Trinidad Express) Two former pilots of British West Indies Airways (BWIA) have sought judicial review against national carrier Caribbean Airlines (CAL) for allegedly retaining foreign pilots without work permits.
The application for leave was filed by Captain Anthony Hamilton and Roger Bridgeman in the High Court on August 19.
The pilots claim that CAL hired six pilots and six co-pilots in contravention of section 10 (2) of the Immigration Regulations made under the Immigration Act Chapter 18:01 of the Laws of Trinidad and Tobago.
The pilots’ position is that they have been unfairly overlooked for employment while CAL hired foreign workers in contravention of the law.
In their affidavits, the pilots claim that having employed pilots without valid Trinidad and Tobago working permits, CAL is at risk of being downgraded as an airline in breach of Federal Aviation Authority (FAA) or European Aviation Safety Regulation (EASA).
The application was heard by Justice Harris who determined that the application was not urgent enough to be heard during the Court’s vacation period.
The claimants are being represented by attorneys at law Peter Taylor and Farid Scoon.
