Calabash granted injunction against stores over fake CWC items

Calabash Gift Shoppe, the official licensee of Cricket World Cup souvenirs and memorabilia, moved to the High Court last week against two local stores allegedly caught selling counterfeit CWC items and was granted an injunction.

The court order restrains the Discount Store and Broadway Fashions – both located on Regent Street – from importing, attempting to import, selling, wholesaling and or retailing any products that bear the CWC 2007 or ICC Cricket World Cup mark or insignia without the approval, consent and or permission of the ICC Cricket World Cup West Indies 2007.

Further, the order states that the two stores are to destroy and or deliver up to the Calabash Gift Shoppe or the ICC Cricket World Cup West Indies all goods in their possession bearing the counterfeit CWC 2007 mark of insignia.

In the court application Elizabeth Deane-Hughes, Arthur Thyme and Nigel Hughes are named as proprietors of Calabash Gift Shoppe.

Strict rules govern the importation, wholesaling and or retailing of CWC souvenirs and memorabilia as set out in the Sunset legislation. Persons found guilty face harsh penalties.

The court matter between Calabash Gift Shoppe and the stores comes up today.
