DPP orders reopening of PI in Carlyle Barton case

The Director of Public Prosecutions (DPP) in accordance with Section 72 (2) (ii) (a) of the Criminal Law (Procedure) Act, 10:01 has directed that the Preliminary lnquiry (Pl) in the matter of Carlyle Barton charged with the offence of murder be re-opened.

A release from the DPP’s Chambers today said that in a letter dated the l6th December,2O13 addressed to Magistrate Fabayo Azore, the DPP has directed that the Pl be reopened for some witnesses to complete their testimony and to allow for other witnesses who had not testified during the first Pl, to do so.

Absent witnesses had resulted in the matter being discharged by the magistrate to the consternation of the public particularly since the police had access to a video with what is said to be damning evidence.

Subsequent to the discharge of the accused Barton for the offence of murder of Shawn Nelson, the DPP statement said that a perusal of the police file revealed that there was a need for certain investigations to be carried out. On the DPP’s advice, the file was sent to the police on the 6th December, 2o13 for these investigations to be carried out.

On the l1th December, 2O13 the police file was returned to the DPP’s

Chambers for further legal advice and is presently in the hands of the

prosecutor.
