Private charge was filed in death by dangerous driving case so police could not institute second charge

Dear Editor,
I hereby acknowledge receipt of letter dated July 19, 2010 in relation to the July 17 letter in SN captioned ‘Inquest found driver culpable in death of my son but DPP’s chambers ruled against charge.’

I wish to inform you that the father of the deceased caused a private criminal charge for the offence of Causing Death by Dangerous Driving to be instituted in 2007. Please find attached to this letter a copy of the case jacket.

The magistrate commenced hearing this charge in the Magistrate’s Court and the defendant pleaded.

This charge was instituted before the completion of the inquest.

A person can only be charged once for an offence. Since a private charge has already been instituted, the police cannot now institute a second charge.
