An elderly Kitty man, who claimed he has hearing problems, has been fined for playing loud music which disturbed his neighbors.
George Mohan, 69, of 58 Station Street, Kitty, appeared to be straining to hear when his matter was called in the Georgetown court of Chief Magistrate Priya Sewnarine-Beharry on Tuesday. As a result, the magistrate was forced to raise her voice as she communicated with him.
He accepted that on October 12, at his residence, he played loud and continuous music to the annoyance of his neighbours. In his explanation to the court, he spoke loudly and said that he did not know that his music had been playing loudly. “I have problems hearing and I didn’t know it was loud,” he explained.
It was at this point that the magistrate explained to him that a not guilty plea would be entered as he was not aware of the loud level at which the music had been playing and did not accept the facts as stated in the charge by the police.
Mohan, however, said that he does accept that the music may indeed have been very loud but he would have been unable to tell because of his hearing difficulties. He explained to the court that he accepted the prosecution’s case unequivocally.
His attorney, Mark Conway, begged the court for lenience, while saying his client did not waste the court’s time.
Noting that Mohan has a hearing impairment, Conway asked the court to impose the most minimal of penalties.
Mohan was then informed that he would have to pay a fine of $7,500, which he told the court he could afford to pay immediately. If he had failed to pay the fine, he would have had to spend two weeks in jail.
