Defence counsel representing Swiss House boss and his beauty queen wife yesterday objected to two additional statements which the prosecution intended to serve.
Farouk Razac and his wife Carolan Lynch are on trial at the Georgetown Magistrate’s Court before Magistrate Gordon Gilhuys for unlawful possession of arms and ammunition. Razac and Lynch are charged with unlawfully having in their possession four 9 mm magazines, one Beretta automatic pistol and 120 rounds of 9 mm ammunition at their Ireng Place, Bel Air home on November 10 last year.
Mark Waldron, one of the couple’s lawyers, on behalf of Nigel Hughes objected to additional statements, which the prosecutor intended to serve.
Police prosecutor Robert Tyndall asked the court to file two other statements. He said that after examining the file he saw that it was vital that he should file these other statements. He said the two statements are for two officers and are part of their case.
Waldron objected saying that the prosecutor had not properly established a proper basis as to why statements were not served on his clients. The statements were then given to the defence to be perused, and Waldron said, “it would seem that one of the officers was the rank who laid the charges against the defendants and the other statement was dated the day prior to the filing of the statements substantive to this matter.” He added that the defence is now ambushed and that the prosecution needs to satisfy the court from a legal standpoint as to why the application should be granted. He concluded that “there cannot be a judicial system where after a trial has started statements are now being filed.”
Tyndall then asked for a short date to ask the Director of Public Prosecutions (DPP) to reply to counsel’s submissions.
The prosecution was yesterday supposed to supply additional statements of Inspector of Police Dexter Thornton.
The case was adjourned and will continue on May 17.
