Dear Editor,
You printed the DPP’s response to the article in the Stabroek News about the DPP not proceeding in the case involving Magistrate Gilhuys (‘Decision to recommend no charges against Magistrate Gilhuys was based on statements sent to the DPP by the police’ 2.9.08).
There are listed 10 reasons for this decision. With regard to reason 7 in which the DPP states that the statements from the police were deficient, it is my understanding that the DPP has the authority, if not a duty, to request additional information if there is a lack of evidence or insufficient evidence provided by the investigating authority to allow the DPP to make a decision on the prosecution.
