A 24-year-old East Ruimveldt man on Friday appeared before Acting Chief Magistrate Melissa Robertson at the Georgetown Magistrate’s Court to answer the charge of indecent exposure.
It is alleged that on June 10 at Georgetown, Junior George of 316 East Ruimveldt exposed his person in an indecent manner.
The defendant pleaded not guilty to the charge when it was read to him.
When given a chance to respond, George said that when he awoke that morning he went to his front door and proceeded to the front drain in his yard to urinate when he realised his neighbour was pulling her window curtain resulting in her seeing him.
He explained further that later that day, the police visited his home and arrested him after informing him that he had exposed himself in an indecent manner.
When asked by the magistrate if he did not have a toilet in his house and if so why he did not use it, George replied that he did have a toilet in his house but since he was at his front door which is close to the drain in his yard, he decided to urinate there instead.
“Meh worship I wake up early de morning and just guh to de drain in front me yard fuh urinate cause it close to whey I went stand up, but me aint show me penis willfully to (the complainant) wuh she saying I do,” George said.
The virtual complainant explained to the court, however, that on several occasions the defendant had positioned himself in his yard when she is outside and would expose himself to her and laugh.
At this point when the Acting Chief Magistrate was about to make her ruling she realised that the police had filed the charge under the wrong section of the law. As a result the unemployed George who was laughing throughout the proceedings, although being cautioned by the Court Orderly not to do so, was then ordered to return to court on June 15 so that the charge can be re-filed and re-read.
