Man tried to sell car that wasn’t his – court hears

Bagot was not required to enter a plea to the indictable charge of obtaining money by false pretence.

The charge alleges that between August 3 and 31, with intent to defraud, he obtained $600,000 from Hilton Baptiste on the pretext that he was the owner of a motorcar which he attempted to sell to him when he knew this to be false.

His lawyer Trenton Lake applied for reasonable bail for him, stating that he poses no risk of flight and although he had been charged before for causing death by dangerous driving, he was never convicted.

However, Baptiste, who was also present in court, stated that Bagot told him that he was the owner of the car that he was selling to him. He said that he made several payments amounting to $600,000 for the car, but Bagot never handed over the vehicle to him.

He noted that after several months and not having received the car he asked that his money be returned but Bagot told him he did not have the money to repay him.

Baptiste said further that Bagot offered him another car which he could use until he had the money to repay him and he agreed.

However several weeks later Bagot contacted him and told him that he had the money to repay him and arranged for them to meet.

Baptiste noted that on the day of the meeting Bagot brought the real owner of the car that he had given to him along with the police to retrieve the vehicle. He said that in an attempt to avoid being arrested for car theft which Bagot was alleging he had committed, he explained the situation to the car owner and the police and Bagot was arrested instead.

Lake then stated that his client and Baptiste did enter an agreement that Baptiste would buy a car from him. He said that Baptiste did receive the car but he found that it was not working and may have been infuriated so he made the current allegations against his client.

Meanwhile, Prosecutor Stephen Telford stated that Bagot would usually rent cars from different persons and pretend that they were his. He said that Bagot would then attempt to sell the cars.

He objected to the bail application on the grounds that the police are currently investigating matters of a similar nature against Bagot and he may flee the jurisdiction if released.

Bagot is expected to make another court appearance on January 22 at Court Three.
