Trial of woman accused of taking cell phone into prison delayed

An adjournment was granted for the commencement of the trial in the matter in which Merceline Small is accused of taking a cell phone into the Camp Street Prison because the prosecution was not in possession of the file.

When the matter was called on Tuesday, the prosecution reported to the court that it was not in possession of its file. Magistrate Hazel Octive-Hamilton, who is presiding over the matter, subsequently granted a July 11 adjournment.

Small has denied the allegation, which states that on January 24, she took the prohibited article into the prison.

When Small made her initial appearance before acting Chief Magistrate Priya Sewnarine-Beharry, she was remanded to prison given the serious nature of the offence.

The defendant was, however, granted bail by the High Court in the sum of $100,000.

The prosecution’s facts are that the accused had gone to the prison to visit someone when she was caught by prison officials taking a cell phone into the prison.

The defendant is the wife of Barry Small, who is one of the two persons accused of murdering schoolgirl Neesa Gopaul. Gopaul’s mother, Bibi Sharima Gopaul, has been jointly charged with Barry Small.
