Man cleared of shooting another on Freeman St in 2017

Six years after the allegation had been levelled against him, Osafo Swain has been cleared of a charge of attempting to take the life of Ewart Blair, who he was alleged to have shot.

Following hours of deliberation yesterday afternoon, a 12-member jury returned a unanimous verdict, finding Swain not guilty.

The charge previously levelled against him stated that on July 26th, 2017 in Georgetown, he discharged a loaded firearm at Blair, with intent to maim, disfigure or disable him.

Swain had been initially indicted for attempted murder; with the alternative count of felonious wounding.

During the course of his trial, however, Justice Simone Morris-Ramlall after reviewing the evidence, directed the jury to return a formal not guilty verdict on the substantive count.

The panel was then given directions on the alternative count and later retired to deliberate a verdict.

It later emerged, unanimously acquitting Swain.

The complainant had testified that at around 21:30 hours on the day in question, he was sitting in front of his Freeman Street, East La Penitence, Georgetown home when Swain, who was armed with a gun, walked up and fired two shots at him.

Blair had also testified that he knew of no reason why Swain would want to harm him since he had no problem with him.

In his testimony, the doctor who had examined Blair, testified that the injuries sustained posed no immediate danger and were not life threatening.

In his defence, the unrepresented Swain invoked his right to remain silent.

The trial was heard at the High Court in Georgetown.
