Patterson found not guilty of indecent exposure charges

APNU+AFC Member of Parliament David Patterson was on Thursday found not guilty of indecent exposure.

Back in July 2023, Patterson appeared at the Georgetown Magistrate’s Court, before Senior Magistrate Leron Daly to answer to three charges which included use of obscene language to provoke a breach of the peace, indecent exposure, and indecent exposure to provoke a breach of the peace.

He was placed on $70,000 bail.

On Thursday he appeared before Magistrate Dylon Bess at the George-town Magistrate’s Court with his attorneys Nigel Hughes and Ronald Daniels, where he was found not guilty on all three counts.

His counsel told the magistrate that the main evidence was that of the virtual complainant, Ramroop Odit. He claimed to have observed Patterson’s genitals but the distance from where he did so, did not permit this, and as such, under cross-examination, he could not provide any evidence as to any description of the pubic area of Patterson. This was compounded by the fact that the man’s hands appeared to be concealing his crotch (also compounded by the fact that the virtual complainant testified that he just looked and looked away within one second). Odit also claimed to have seen Patterson urinating on two other occasions, however, video evidence disclosed that the defendant’s back was turned toward the virtual complainant.

The video was also unhelpful insofar as there was no clear image of the person claimed to be Patterson. The audio also was of no use as the area was filled with traffic noise traffic and music from across the road.

It was alleged back in July16, 2023, at 87 Seaforth Street, Section ‘A’, Campbellville, Georgetown, that Patterson exposed his genitals to Odit.

It was also alleged that on the same date, and at the same location, Patterson used obscene language to Odit in breach of the peace.

It was further alleged that Patterson, on the same date, and at the same location, intentionally tried to provoke Odit, by causing him distress.
