Magistrate Fazil Azeez on Tuesday dismissed a charge of possession of narcotics for the purpose of trafficking against a 37-year-old man after his counsel made successful no-case submissions.
Trevor John, 37, of the Campbellivlle Housing Scheme was on trial at the Leonora Magistrate’s Court after being charged with the possession of narcotics for the purpose of trafficking.
The prosecution’s case had alleged that on July 22 last year at the Cornelia Ida, West Coast Demerara public road, he had 56 grammes of cocaine for the purpose of trafficking.
The prosecution witness after giving his evidence-in-chief had been cross-examined by the defendant’s lawyer, Stephen Lewis but after the matter was adjourned for further cross-examination to continue, the witness never returned to court. In his continued absence, the prosecution was forced to close its case and Lewis in his no-case submissions argued that there was no evidence led for the court to call on the defendant to lead a defence.
The defence counsel’s submissions were upheld by the magistrate on Tuesday and the matter was dismissed.
