After 17-year court battle ex-wife gets judgment

After battling in court for 17 years over the division of properties she had shared with her now ex-husband, Jeannette Prince had a judgment of $2.2M granted in her favour by Justice Jainarayan Singh Jr recently.

Prince filed for divorce and for division of property in 1991 after separating from her husband, Darymple Prince. She had also sought an injunction restraining him from selling any of their assets but this was not granted.

In 1991 while the matter was then engaging the attention of the High Court, Prince’s husband sold 3 of the 4 properties they owned, shutting her out from the proceeds. One of the properties sold was a business place known as ‘Daljean’ Hotel and Liquor Restaurant.

Attorney-at-law Samuel Brotherson [now deceased] had filed the High Court claim on Prince’s behalf and after he died attorney Gem Sanford-Johnson appeared in the matter for her. For years the matter was in the High Court and was heard by several judges before it reached Justice Singh.

In ruling Justice Singh said that $2.2M is to be awarded to Prince as her share of the proceeds of sale, and she is also to receive $30,000 monthly from her ex-husband for rent he receives from one of the properties they still own. The court also ordered that he pays her $100,000 in refunds for rates and taxes paid on the property they own and she was also awarded $75,000 in costs.

Sanford-Johnson after the ruling commented that it took years for the matter to be disposed of but “finally there was justice.”  She said the ex-husband has since asked for a stay of execution, which was granted, and will soon appeal the ruling.
