Essequibo businessman files contempt motion against Demerara Bank

– over failure to pay judgement award

Essequibo businessman, Arnold Sankar has filed a contempt motion against the directors of Demerara Bank Limited for failing to comply with a High Court order which awarded him $85 million in a judgement against Mahaicony Rice Ltd.

Sankar named Chief Executive Officer of the bank Pravin Dave and directors Hemraj Kissoon and Dr Leslie Chin in the court action saying that they have refused to pay him the monies awarded in a judgment handed down by Justice Rishi Persaud last month.

Sankar said the refusal by the bank is in complete disrespect of the judge’s ruling of September 27. He made reference to the ruling which had specifically ordered that the bank pay him the money from the bank guarantee/bank bond lodged with the Registrar of the Supreme Court.

Following the bank’s refusal to pay Sankar said Deputy Registrar of the Supreme Court Rasheed Mohamed had cause to write a letter to Demerara calling on the bank on October 19 to comply with the court order, but that the bank refused to comply.

Subsequently Sankar’s attorney, Anil Nandlall wrote to the bank’s CEO on October 20 informing him that the bank was acting in contempt of the court order by refusing to pay his client.

Sankar said a Marshall at the High Court also had cause to personally serve the named respondents with the court order on Friday last.

The contempt hearing comes up again early next month.
