Missing ‘element of knowledge’ sees dismissal of $8M theft case

A man, who was charged with stealing over $8 million in cell phones and other items from Celebrity Cell Phone Store, was freed of the charge yesterday at the Georgetown Magistrates’ Court.

The allegation was that on May 4, 2012, at Regent Street, Bobby Moore of 14 Norton Street, Lodge, broke and entered Celebrity Cell Phone Store and stole a quantity of cell phones, accessories, laptops and other items all totalling $8,658,500, property of Tiffany Jairam.

But Moore claimed that someone else  had given him the articles.

That person is currently in prison on a murder charge.

Moore’s attorney Lyndon Amsterdam in closing submissions to the court yesterday stated that there was no evidence to show what was stolen other than general statements. He said too that the court was not provided with the brand of cell phones stolen.

Amsterdam further advanced that laziness in investigating had placed the prosecution in the position it was in, adding that there was no fingerprint evidence.

Magistrate Leron Daly said she could not ask Moore to lead a defence because the element of knowledge is missing. She later dismissed the case.

Moore had earlier appeared before Chief Magistrate Priya Sewnarine-Beharry, where he pleaded not guilty to the charge and was released on $400,000 bail.
