The charge against Heeranand Boodhram, one of the drivers involved in the fatal Sheriff Street collision that resulted in the death of four-year-old Ambeka Providence in 2016, has been dismissed after a city magistrate ruled that there was insufficient evidence against him.

Boodhram, of Lot 336 Sachi Bazaar, Prashad Nagar, had pleaded not guilty to the charge that on September 10th, 2016, at Sheriff and Garnett streets, he drove pickup truck GPP 3500 in a manner dangerous to the public, thereby causing the death of Providence.

During yesterday’s hearing, Senior Magistrate Leron Daly dismissed the charge after ruling that there was insufficient evidence against Boodhram.

The policeman who conducted the investigation moved out of the country shortly after the accident and had not testified during the trial. Prosecutors’ attempts to contact the former policeman were unsuccessful.

Meanwhile, a second accused, Dereck Bailey, is also before Magistrate Daly on a similar charge. It is alleged that Bailey drove motor car PMM 1426 in a manner dangerous to the public, thereby causing the death of Providence.

It is the prosecutor’s case that on the day in question, at 10.20pm, Bailey was parked in the parking lot of the Royal Castle outlet on Sheriff Street, while Boodhram, who was in his pickup, was proceeding north and approaching Garnett Street. It is alleged that the traffic light was showing green when Bailey drove out of the parking lot, heading east to west on the road, as Boodhram was crossing the junction. The vehicles collided at the intersection and as a result of the accident, Provi-dence, who was sitting in Bailey’s car, died.
