Imperative for City Council to assert ownership rights over Carifesta Avenue land

The recent deal between the government and a Qatari company to construct a hotel on the land at Carifesta Avenue has raised concerns about the ownership of the property.

According to the official gazette of 1887, which serves as a legal document, the land at Carifesta Avenue is designated as the property of the state. It unequivocally states that the land is under the control and ownership of the City Council. Thus, any transactions involving this land should follow proper legal procedures and involve the rightful owner, and the surveyor plan published by the government is not the original surveyor plan according to the gazetted order 1887.

It is disappointing to note that the government, as the highest administrative authority, has failed to honour the obligations of ensuring the legality of land deals. By entering into an agreement with a foreign company without involving the City Council, they have infringed upon the rights and authority of the rightful owners. This casts doubt on the government’s commitment to transparency and accountability, which are essential for maintaining the public’s trust.

Given the clear evidence presented in the official gazette, it is imperative for the City Council to assert their ownership rights over the Carifesta Avenue land. The Council holds significant responsibility to safeguard public property and ensure its appropriate utilization for the benefit of the city’s residents. It is the duty of the City Council to take immediate action and rectify this situation.

I strongly urge the City Council to initiate legal proceedings against the government’s unauthorized transfer /occupied of the Carifesta Avenue land to the Qatari company. They must stand firm in their struggle to protect the rights and interests of the city. Failure to act swiftly could set a dangerous precedent, potentially encouraging the government to repeat similar actions in the future.
