Duo granted $75,000 bail each on attempted break and enter charge

When they first appeared before Magistrate Robertson on Tuesday, charged with attempting to commit a felony, they were refused bail.

It is alleged that on March 21 at Georgetown they attempted to break and enter the dwelling house of Ronald Haniff with intent to commit larceny.

They were not required to plea to the charge.

On that occasion, Attorney-at-Law Basil Williams appeared on behalf of both of the accused. He had told the court that Vigilance, 22, of 36 D’Andrade Street, Newtown and Murray, 25, of 11 Roxanne Burnham Gardens had no prior convictions and there was no evidence to show that the accused were in the building.

Williams also argued that there was nothing in law as it regarded an attempt. He said the charge was merely one of a speculative nature and asked for the granting of reasonable bail.

While the VC in the matter was not in court, the proprietor of the building, Emelda Azeez was present. She told the court that on checking the exterior of the house, she found the window on the northern side broken and a screwdriver and other implements in the yard.

She further stated that the accused were found lying in the grass without their shirts on. They were asked to get up by the police and were taken to the station.

Williams had contended that there was no way to prove who the tools belonged to and how long they had been there.

Police Prosecutor Inspector Stephen Telford had asked for bail to be refused. He said that a neighbour saw the actions of the accused around 3 am and called the police.  Upon inspection, a window was discovered damaged.

The matter was put down for April 6 when additional charges relating to damage to property are expected to be laid.
