Accused in ganja, ammo bust tells court of toilet confrontation

Agricola resident Leyland Leo, charged with possession of a narcotic and ammunition, told a court on Monday that he was confronted about the items while on the toilet.

Leo, 40, of 68 Brutus Street, Agricola, East Bank Demerara was remanded to prison when he appeared before Magistrate Hazel Octive-Hamilton at the Georgetown Magistrates’ Court.

The allegation against Leo is that on June 21, at Agricola, he had in his possession 70 grammes of cannabis for the purpose of trafficking. On the same day, he is alleged to have had in his possession two .43 Winchester ammunition without a licence. He denied both charges.

The unrepresented accused, who requested bail, was told that he must advance to the court special reasons relating to the offences—and not himself—for his pre-trial liberty to be considered.

In his response, Leo said that on the day in question, he was in his toilet when some men kicked down the door and exclaimed, “look wah we find!” When asked if the men were police, he told the magistrate that none of them identified themselves to him.

The prosecution objected to the accused being granted bail, saying that its facts differed. According to Police Corporal Simone Payne, the cannabis and ammunition were found in a tin in the defendant’s home. She said the items were shown to him and he denied ownership.

Leo was subsequently remanded to prison and he will make his next court appearance on July 6.
