Break and enter accused offers defecation defence

A man was remanded to prison yesterday when he appeared before Acting  Chief Magistrate Melissa Robertson charged with attempting to commit a felony.

Junior Luther, 35, pleaded not guilty when he was read the charge of attempting to break and enter the dwelling of Lurain Mitchell on June 21.

Luther told the court that on the day in question he wanted to defecate while he was on the road.  Having no where else to go, he said that he jumped over the fence and took a bucket he found in the yard and made use of it.

Police Prosecutor Kelvin Whittaker said that when Luther went into the yard he was caught by the security guard on duty.  He added that Luther was showing disregard for the police when he suggested that they look for the evidence of his relieving himself in the yard.  He objected to bail being granted.

Luther was then remanded and the matter put down for July 16.
