Sherod Duncan acquitted of cyber charge – legal firm

Member of Parliament Sherod Duncan has been acquitted of a charge of using his computer to humiliate and cause emotional distress.

A release yesterday from Hughes, Fields and Stoby said that on January 17th 2023, Duncan was charged with the offence of “Using a Computer System to Humiliate a Person.” The release said that the prosecution alleged that on 11th January 2022 at Diamond, East Bank Demerara, Duncan used a computer system to transmit electronic data with intent to humiliate, harass or cause substantial emotional distress to Guyana Elections Commission employee, Aneal Giddings.

The release said that the trial was conducted by Principal Magistrate Judy Latchman at the Diamond Magistrate’s Court, East Bank Demerara and the prosecution was represented by Police Legal Advisor Mandel Moore.

At the close of the prosecution’s case, the release said that the Defence argued that the Prosecution had not led sufficient evidence for Duncan to be called upon to lead a Defence.

After considering both written and oral arguments on behalf of the Prosecution and Defence, yesterday, Magistrate Latchman upheld the No Case Submission made by the Defence and dismissed the matter against Duncan.

The release said that Duncan was represented by Nigel Hughes, Narissa Leander and Iyanna Butts.
